Learned Counsel for the petitioner submits he is in custody for more than three years. It is also submitted most of the witnesses have not identified the petitioner in test identification parade. He renews his bail prayer. 2.

Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record.

Petitioner has been identified by one witness during test identification parade as well as court. His fingerprints were found at the place of occurrence. Trial has substantially progressed. Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.
