A direction to secure expeditious disposal of an injunction application under Order 39 Rules 1 and 2 of the Code of Civil Procedure, filed by the petitioner/plaintiff on 25.11.2020, is the ultimate relief sought for in this case.

No other point is raised requiring address by this Court.

Nothing is revealed in the photocopies of the orders passed by the learned Court below that after filing such application for injunction, it was moved before this Court below at any point of time. That being the position, petitioner is given liberty to take up an application taking advantage of this order for moving the pending injunction application within a fortnight from the date of communication of this order to the Court below.

If any such application is filed by the petitioner/plaintiff, the same shall be considered in accordance with law, giving a hearing in connection with pending application under Order 39 Rules 1 and 2

of the CPC.

Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and the opposite parties.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
