Mr. Bidyut Kumar Halder, Mr. Indranil Halder, Ms. Neha Singh, Ms. Srabanti das ...for the petitioner Mr. Debjit Mukherjkee, ...for the CESC Limited Learned counsel appearing for the petitioner argues that due to resistance of the private respondent no. 4, the CESC Limited is not being able to give electricity connection to the petitioner.

Such stand is corroborated by learned counsel for the CESC Limited, who further submits that the CESC personnel went to give a loop meter connection to the petitioner but could not do so since the private respondent and/or his men and agents offered obstruction.

From the affidavit of service filed today it is evident that despite service, the private respondent choose not to appear before this court.

Hence, W.P.A. No. 11003 of 2023 is taken up for hearing in the absence of the private respondent.

In view of the petitioner being prima facie in settled occupation of the property and having complied with all formalities, the CESC Limited is directed to give a new electricity connection by way of a loop meter to the petitioner from the existing meter board position as expeditiously as possible, positively within a week from date.

In the event any obstruction is offered by the private respondent and/or his men and agents, the CESC personnel will be at liberty to approach the respondent no. 3, the officer-in-charge of the Sankrail Police Station, for adequate police assistance. If so approached, the respondent no. 3 shall give such assistance at the cost of the petitioner. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
