Re : An application under Section 482 of the Code of Criminal Procedure. .

The revisional application was preferred at a stage when the investigation of Howrah P. S. Case No. 294 of 2020 dated 23.09.2020 was just concluded and chargesheet was filed before the jurisdictional court.

Report has been submitted by Mr. Bitasok Banerjee, learned advocate appearing on behalf of the State. Report reflects that the Investigating Agency has relied upon at least eight witnesses to prove its case. So far as the revisional application is concerned, the petitioner has only enclosed the FIR and the chargesheet. Having considered the fact that the documents under Section 207 of the Code of Criminal Procedure on which the prosecution proposes to rely upon are not before this court, I am of the opinion that this court is not in a position to interfere with the pending proceedings.

However, the petitioner would be at liberty to canvass such points at the appropriate stage of the trial. With the aforesaid observations, the revisional application being CRR 1467 of 2021 is disposed of.

Pending applications, if any, are consequently disposed of. The report of the Inspector-in-Charge, HPC and the memo of evidence be kept with the court.
