The victim in her statement before the Magistrate stated that although she has having an illicit relationship with the present petitioner for some time, on one occasion, he came along with another individual Rubel Mondal and permitted sexual assault upon her. The said co-accused is in custody. In view of the incriminating materials available in the case diary including the statement of a neighbor contained at Page 14 of the case diary, I do not consider that this is to be a fit case to grant anticipatory bail.

Accordingly, the prayer for anticipatory bail to the petitioner is rejected.
