The writ petitioners are aggrieved by the fact that despite presentation for registration in the year 2006, the registered deed has not been handed over to his client by the Additional District Sub-Registrar, Goas, Murshidabad.

Counsel for the State submits that the registered deed could not be handed over since indexing could not be done.

This Court is unable to believe the instructions of the respondent no.3 that indexing has not been done in respect of the documents registered with the Additional District Sub-Registrar, Goas, Murshidabad from 2006 till date.

This Court deems the excuse as lame.

The District Collector, Murshidabad shall look into the matter and also examine the instructions given to the State Advocate by the Additional District Sub-Registrar, Goas, Murshidabad.

The Additional District Sub-Registrar, Goas, Murshidabad, the respondent no.3 herein, is hereby directed to hand over the registered deed to the petitioner upon production of appropriate document within a period of three weeks from date.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
