The petitioner is aggrieved by the fact that she is being harassed and heckled at the behest of the private respondent no.4 and as such, she approached the police authorities. However, the police authorities refused to take any action. Mr. Banerjee, learned AGP appearing for the State submits that earlier there was similar complaint for which case was registered in the year 2023 being Bidhannagar North Police Station Case No. 88/2023 dated 06.06.2023 and subsequently final report has been filed after investigation. According to the learned advocate, similar complaints are being filed regularly with the police station.

Be that as it may, the petitioner would be at liberty to approach the jurisdictional criminal court under the relevant provisions of Section 175(3) of

BNSS 2023. The learned court would consider the accusations as to whether any cognizable offence has been made out and after adhering to the relevant provisions of law would pass necessary orders keeping in mind that the petitioner/lady is being harassed.

In the meantime, the police authorities would keep a strict vigil and respond to any complaint in respect of deterioration of any law and order situation, if the same happens because of the plight expressed by the petitioner.

With the aforesaid observations, the writ petition being WPA 11810 of 2024 is disposed of. There shall be no order as to costs.
