Learned senior advocate appearing for the petitioner submits that the petitioner is in custody for nine months and there has been no recovery from the present petitioner. Other accused persons have been granted bail and the accusation against the present petitioner is that he was accompanying the carriers who had been to a foreign country and returned from there.

Learned advocate appearing for the DRI Authority, on the other hand, opposes the prayer for bail and submits that the present petitioner was carrying his operation pursuant to the directions of the principal accused viz. Tausif Ahmed. Learned advocate submits that the quantum of seizure is of commercial quantity and CDRs and money trail also reflect the complicity of the present petitioner with the principal

accused. Additionally, it has been submitted that petitioner's contacts are not limited to the carriers, but is a part of the racket who are operating the export and import of the contraband.

I have taken into account the period of detention of the present petitioner which is for a period of nine months and the complaint refers to about 30 witnesses to be relied upon by the prosecution which will take substantial time. Having considered the same, I am inclined to enlarge the petitioner on bail. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Wajed Ali Mondal shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Bench-I under the NDPS Act, City Sessions Court, Calcutta.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the area of Kolkata Metropolitan Development Authority without prior permission of the learned Special Court.

The petitioner shall also once in a month for a period of six months meet with the Investigating Officer of the case and/or any Officer authorised by the Deputy Director, DRI. The application for bail, being CRM (NDPS) 1055 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
