1. The grievance of the petitioner is directed against the refusal of the CESC Limited in transferring the electricity connection in the name of the petitioner.

2. It is submitted on behalf of the petitioner that the erstwhile consumer had expired and the petitioner is entitled to such connection.

3. On behalf of the CESC Limited it is submitted that, the erstwhile consumer is alive. In view of the false averments made in the writ petition and the misrepresentation of the materials facts, WPA 11339 stands dismissed.

4. Liberty is granted to the CESC Limited to take necessary steps in accordance with law, if so advised.
