Petitioner(s) Mr. Kaushik Choudhury Mr. Dwaipayan Panda ... for the Petitioner(s) Mr. Moyukh Mukherjee Mr. Sanjib Das ... for the State-respondent(s) Learned advocate for the petitioners submits that there has been alleged recovery of 296 gm of heroin from the present petitioners and three other accused persons. Learned advocate also submits that the petitioners are in custody for eight months; till date charges have not been framed and the prosecution has relied upon 10 witnesses in order to prove its case.

Learned advocate for the State submits that charges have already been framed and date was fixed for commencement of the trial.

Having considered the period of detention of the present petitioners and the quantum of seizure, I am not inclined to enlarge the petitioners on bail.

Hence, the prayer for bail of the petitioners is Rejected.

However, the petitioners would renew their prayer for bail after the evidence of the seizure list witnesses is over. The learned trial court is directed to give priority to the seizure list witnesses and the same be completed within a period of three months from the date of communication of this order.

Accordingly, CRM (NDPS) of is dismissed.
