Petitioners prefer for early disposal of M.P.Case No.692 of 2018 which is a proceeding under Section 147 of the Code of Criminal Procedure.

Last of the order-sheets so enclosed are of 8.2.2024. I find that Inspector-in-Charge, Haldia Police Station and BL & LRO, Sutahata were directed to submit their reports and reminders were issued by the learned Executive Magistrate. The concerned authorities would file their reports within 60 days from date before the learned Executive Magistrate and the learned Executive Magistrate will thereafter exercise his discretion in respect of the prayers so advanced by the petitioner. Needless to state that this Court has not gone into the merits of the case and the learned Executive Magistrate will independently decide whether the proceedings under Section 147 of the Code of Criminal Procedure are maintainable pursuant to the report so filed by the Inspector-inCharge, Haldia and BL & LRO, Sutahata. With the aforesaid observations, CRR 1761 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.
