Banerjee) Mr. Keshab Chandra Das Ms. Aparajita Mondal ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the first defendant praying for a direction upon the learned Civil Judge (Sr. Division), 1st Court at Hooghly to dispose of Title Suit No. 264 of 2019 expeditiously. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the learned advocate representing the opposite parties before the learned trial judge.

From the order-sheets appended to this application this court finds that the application under Order 39 Rule 4 of the Civil Procedure Code is still pending.

Learned advocate appearing for the petitioner submit that the written objection to such application has already been filed and the application for injunction is otherwise ready for hearing.

In the light of the aforesaid submission, CO 1734 of 2025 is disposed of by requesting the learned Civil Judge (Sr. Division), 1st Court at Hooghly to take up the hearing of the injunction application and the application under Order 39 Rule 4 of the Code on the next date fixed, if the same are otherwise ready for hearing and make an endeavour to dispose of the aforesaid applications arising out of Title Suit No. 264 of 2019 as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
