Ct.No.28.
as (Rejected) C.R.M. (DB) 1683 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Berhampore P. S. Case No.775 of 2021 dated 28.07.2021 under Sections 406/420/467/468/471/120B of the Indian Penal Code. In the matter of : Santosh Hazra.
.... Petitioner.
Mr. Ali Ahsan Alamgir, Ms. Riya Das, Ms. Rabia Khatoon.
...for the Petitioner.
Mr. Rudradipta Nandy, ld. A.P.P., Ms. Eshita Dutta.
...for the State.
Heard the learned Counsels appearing on behalf of the parties.
Petitioner renews his prayer for bail. He submits he is on same footing with the co-accuseds who have been granted bail. Learned Advocate for the State opposes the prayer for bail. He submits petitioner is the king pin who had entered into conspiracy with other accused persons in procuring public employment by using forged and fabricated documents. We have considered the materials on record. Statements of witnesses and other materials show the principal role of the petitioner in the conspiracy of cheating individuals on the false promise of procuring public employment by using forged and fabricated documents.
In view of the prima facie involvement of the petitioner in the alleged crime and gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.
Accordingly, the prayer for bail of the petitioner is rejected.
