Heard the learned Advocates appearing for the parties. Petitioner is in custody for about 93 days. It is submitted de-facto complainant and others trespassed into their property and caused damage. A case was registered against them. Petitioner is a lady and has been falsely implicated. Learned Public Prosecutor opposes the prayer for bail. We have considered the materials on record. Statements of witnesses recorded under Sections 161 and 164 of the Code of Criminal Procedure state petitioner was armed and participated in the assault of the deceased.
In view of the aforesaid incriminating materials on record and gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.
Accordingly, the prayer for bail of the petitioner is rejected.
