Report filed on behalf of the State is taken on record. Learned senior counsel appearing on behalf of the petitioners submits as follows. There was a complaint made by a practicing lady advocate of the local Court that there was a scuffle between her and the petitioners. She was allegedly molested and roughed up regarding an issue of parking of cars. The petitioners had allegedly consumed liquor on that day. The petitioners have been falsely implicated in this case.

Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He refers to the statements of the victim and all other witnesses. However, there is no independent local witness who had seen the incident. The report also do not show any criminal antecedent.

Considering the above and the other materials available in the case diary, although I am inclined to grant anticipatory bail to the present petitioners, their movement shall remain restricted for a limited period.

Accordingly, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of Arresting Officer and subject to the conditions as laid down under Section 438 of the Code of Criminal Procedure, corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita and on further condition that the petitioners shall cooperate with the investigation and shall not threaten or intimidate witnesses or tamper with evidence in any manner whatsoever and the petitioners shall meet the Investigating Officer once a week till submission of report in final form and shall stay outside the jurisdiction of Asansol (S) Police Station for a period of two months except for meeting the Investigating Officer or attending the jurisdictional Court. The application for anticipatory bail is, thus, disposed of. The presence of the Investigating Officer is noted and is dispensed with.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
