Mr. Srijib Chakraborty, Mr. Aditya Mondal, Mr. Washim Akthir Dafader ...for the Petitioner Mr. Biswaroop Bhattacharyya, Mr. Sumitava Chakraborty, Ms. Rupsa Sreemani ...for intervenor, Student Mr. Parashar Baidya ...for the University By filing the present writ petition, the petitioner-college 15-05-2025 AKG Ct. 15 alleges that although respondent no. 1 forwarded the names of 15 students in the third phase of admission for the English subject in B.Ed course. First semester for the academic session 2024-2026, only three of them could be admitted. The admission of the remaining 12 students could not be processed due to technical issues on the web portal maintained by respondent no. 1.
Respondent no. 1 does not dispute the college's intake capacity, and it is also an admitted position that the names of the said 12 students appeared in the merit list prepared by the university.
In view of the above, the college is directed to approach the university for the admission of the aforementioned 12 students within three days from the date of this order. Upon such approach, the university shall regularise the admission of the said students, subject to the completion of all
requisite formalities by the college.
The university, however, submits that it has issued a show-cause notice to the college regarding deficiencies in infrastructure and a shortage of teaching staff, which has not yet been responded to by the petitioner.
The college is accordingly directed to submit a reply to the show-cause notice along with the necessary supporting documents. The university shall afford the college an opportunity of hearing before taking a decision on the showcause notice. It is clarified that the university shall be at liberty to pass appropriate orders after granting such hearing, in accordance with law.
It is further clarified that this order shall not be treated as a precedent in any future matter.
The allegations made in the present writ petition shall be deemed to have been denied by the university. Accordingly, WPA 10782 of 2025 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
