Heard learned Advocates appearing for the parties. By this writ petition, petitioner has challenged the impugned notice dated 10th November, 2022 issued by the respondents/Securities and Exchange Board of India asking the petitioner to make payment of the dues in question and to furnish details of moveable and immovable properties. Instead of making appropriate representation before the authority concerned, if petitioner at all has any case in his favour, he has approached this court under Article 226 of the Constitution of India.

I am not inclined to entertain this writ petition since the appropriate remedy for the petitioner will be to make representation before the authority concerned for redressal of his grievance, if at all he has any case against the aforesaid impugned notice. Accordingly, this writ petition being WPA 11039 of 2023 is dismissed.

However, dismissal of this writ petition will not be a bar on the part of the petitioner to make appropriate representation against the impugned notice dated 10th November, 2022, before the authority concerned, which may be considered by the authority concerned in accordance with law, if so made.
