The certified copy of the order sheet of the trial court is filed in court today as per previous direction of a coordinate Bench and is kept on record.

Learned counsel for the petitioner submits that a divorce suit filed by the petitioner against the opposite party has been kept pending for a prolonged period of about four years.

It transpires from the order sheet that an application for amendment of the plaint under Order VI Rule 17 of the Code of Civil Procedure is also pending at the behest of the petitioner.

In view of the innocuous nature of the proposed order, prior service of notice to the opposite party is dispensed with. Since a matrimonial suit is urgent by its very nature, an appropriate direction ought to be passed, in the opinion of this court, for expeditious hearing of the suit and the connected application.

Accordingly, CO No. 1538 of 2024 is disposed of by requesting the learned Additional District Judge, Fast Track Court, Fifth Court at Barasat, District - North 24 Parganas to dispose of all applications pending before the said court in connection with Matrimonial Suit No. 1944 of 2021 as expeditiously as possible, preferably within November 30, 2025. Thereafter, the learned Trial Judge shall make endeavour to dispose of the suit itself at the earliest, preferably within six months thereafter.

There will be no order as to costs.

The parties shall act on the server copy of this order duly downloaded from the official website of this court.
