Petitioners are the parents who have complained that they apprehend that they may be subjected to physical and mental harassment at the instance of the private respondents.

Prima facie on the submissions made by the learned advocates appearing for the petitioners as well as the private respondent no. 7 it seems that, there exist a family dispute.

State has already earlier submitted a report. Since, from the facts of the case it transpires that respondent no. 6 is staying at Durgapur and respondent no. 7 is staying at the matrimonial home.

Having considered the nature of the dispute, I direct that the police authorities would be sympathetic to the petitioners who are aged parents. In case they are in difficulty but in the interest of justice it would be better advised that they approach the appropriate authority under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. In case any order is passed by the said authority, the police authorities would ensure that the same is implemented in letter and spirit. Police authorities would also keep a surveillance and ensure that no breach of the peace or tranquility or any untoward incident results because of the strained relationship as has been represented before this court.

With the aforesaid observations WPA 11049 of 2023 is disposed of.
