Banerjee) Mr. Debabrata Roy ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the wife praying for a direction upon the learned Additional District Judge, 4th Court at Barasat to dispose of Matrimonial Suit No. 135 of 2017 expeditiously. Learned advocate appearing for the petitioner draws the attention of the court to an order dated September 6, 2023 passed by a coordinate Bench in CO 64 of 2023 wherein a direction was passed upon the learned trial judge to dispose of the Matrimonial Suit as well as the (Act VIII) Misc. Case No. 32 of 2016 within a period of one year from the next date fixed.

Learned advocate appearing for the petitioner submits that the learned trial judge has not followed the said direction of the coordinate Bench.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any

notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge.

From the order-sheets appended to this application it appears to this court that May 19, 2025 has been fixed for further examination of PW-1. Since a coordinate Bench by an order dated September 6, 2023 has passed a direction for expeditious hearing, this court is of the considered view that it is not necessary to pass a further direction upon the learned trial judge.

The learned trial judge is requested to keep in mind the mandate of the coordinate Bench in the order dated September 6, 2025 passed in CO 64 of 2023.

With the above observations CO 1739 of 2025 stands disposed of.
