We are informed that the incumbent has joined his posting in the trial court.

Heard the learned Advocates for the parties.

Date has been fixed for examination of the last prosecution witness on 13.06.2023. Though the petitioner is languishing in jail for more than ten years, in view of matured stage of the proceeding, we request the trial court to examine the last prosecution witness on the date fixed. In the event, the Court is unable to do so due to circumstances beyond control, the said witness shall be examined within the month of June, 2023. Thereafter, the trial shall be disposed of the matter on a priority basis preferably within six months from the examination of the said witness.

In light of expectation that the proceeding will come to a conclusion in conformity with our direction, as aforesaid, bail prayer of the petitioner is rejected at present. Parties shall co-operate with the trial court in this regard. Parties shall also communicate this order to the trial court for due compliance.

Presence of the Investigating Officer is noted and dispensed with.
