In Re : An application under Section 401 read with Section 482 of the Code of Criminal Procedure.

The revisional application was preferred against the order dated 09-12-2011 passed by the learned Judicial Magistrate, 3rd Court, Howrah in connection with Misc. Case No. 47 of 2007 under Section 125 of the Code of Criminal Procedure.

The order reflects that the learned Magistrate was pleased to allow interim maintenance of Rs.1500/- per month to the wife and another Rs.1500/- per month for the child. Having regard to the fact that the order was passed by way of an interim measure during the pendency of the main proceedings under Section 125 of the Code of Criminal Procedure, I am of the view that no interference is called for by this court at this stage.

Accordingly, the present revisional application being CRR 1617 of 2012 is dismissed.

All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
