2026-06-10Hon'Ble Justice Jay Sengupta2 pages

10.06.2026 Sl. No.70 Ct. 28 NB C.R.M (A) 1440 of 2026 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Baishnabnagar PS Case No.1360/2025 dated 18.10.2025 under Sections 179/180/61(2)/111(3)/111(4) of the BNS. And In the matter of: Selim Saikh ... petitioner Mr. Arup Kumar Bhowmick ...for the petitioner.

Mr. Krishnendu Bhattacharya, Mr. Saswata Chatterjee.

...for the State.

Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been falsely implicated in this case. Other than the statement of a co-accused, which is not admissible in evidence, there is no other material to implicate the present petitioner. Charge sheet has been submitted. Learned Additional Public Prosecutor representing the State relies on the report and strongly opposes the prayer for anticipatory bail. He submits that the phone call records of the petitioner and the arrested accused show that they were in constant touch with each other on the relevant date. The call tower location and analysis of the accused also support the prosecution case. Fake currency notes to the tune of Rs.7.85Lakhs were seized from the arrested accused.

Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail to the present petitioner. The application for anticipatory bail of the petitioner is, thus, rejected.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
