Ajit Khan v. State Of West Bengal
IN THE HIGH COURT AT CALCUTTA
Criminal Revisional Jurisdiction 16-06-2022 Subha Item no.63 Ct no.34 CRR 1931 of 2022 In the matter of : Ajit Khan. .....petitioner. In Re : An application under Article 227 of the Constitution of India Mr. Atis Kumar Biswas Mr. Amit Singh Ms. Jyoti Agarwal ......for the petitioner.
Mr. Anwar Hossain Ms. Debjani Sahu ....for the State.
The petitioner expresses his anxiety as he is in custody since 20th March, 2019, which is more than three years two months. According to the learned advocate for the petitioner out of 9 witnesses so cited by the prosecution, till date only two witnesses have been examined.
In view of the aforesaid, the petitioner is directed to serve a copy of the revisional application upon Mr. Anwar Hossain, learned advocate, who ordinarily appears on behalf of the State to represent the State. The appointment of Mr. Anwar Hossain, learned advocate may be regularized by the concerned authorities in due course. The Learned trial court is directed to fix a schedule consisting of three dates and such schedule must be fixed once in a month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournments should be granted to either of the parties and the learned Public Prosecutor
conducting the case on behalf of the prosecution would ensure the court regarding the availability of the witnesses prior to a date/schedule being fixed by the learned court. It is reiterated that the learned trial court should keep in mind while fixing dates that the petitioner is in custody for about 38 months and take all efforts so that by 31st December, 2022, the trial of the case is concluded.
With the aforesaid observations, the revisional application being CRR 1931 of 2022 is disposed of.
All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
