Kausik (Rejected) CRM (NDPS) 1068 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Special Task Force HQ Police Station Case No. 10/2025 dated 08.10.2025 under Sections 21(c)/29 of the NDPS Act.

Petitioner prays for bail as he has been arrested subsequently on the basis of statement of the co-accused. Earlier the prayer for bail was rejected on 09.04.2026. The observations therein were to the effect that there were Call Data Records/Call Detail Records connecting the present petitioner with the accused persons which was more than 300 in number. Learned advocate for the petitioner emphasizes on the Chemical Examiner's Report which was not placed at the relevant point of time when the earlier application for bail was placed before this Court.

I have taken into account the same and I find that the threshold commercial quantity required do not in any manner violate the quantum of seizure in the case which has been effected.

Learned advocate for the State submits that charges have already been framed and witness action is about to commence.

Having considered the quantum of seizure involved, the complicity of the petitioner as also the opportunity which should be granted to the prosecution to establish its case, at this stage, I am not inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner in CRM (NDPS) 1068 of 2026 is dismissed at this stage. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
