.....For the State This is an application under Article 226 of the Constitution of India wherein the writ petitioner is seeking an innocuous payer for consideration of his prayer of grant of an auto-rickshaw permit.

It is to be noted that the petitioner's application for auto-rickshaw permit was rejected by the authority concerned. The petitioner prays that the Principal Secretary, Department of the Transport, may consider his prayer after granting an opportunity of hearing. I have heard counsel for both the parties and perused the materials on record.

Accordingly, I direct the petitioner to make a formal application before the principal secretary, Department of Transport within a period of two weeks from date. In my view, this writ petition may be disposed of with a direction upon the authority concerned.

Accordingly the Principal Secretary, Department of Transport, is directed to pass a reasoned order after granting an opportunity of hearing to the petitioner within a period of four weeks from date. The reasoned order should be communicated to the petitioner within a week of passing of the same.

With the above direction, the writ petition being WPA 11679 of 2021 is disposed of. There will be no order as to costs.

Since no affidavit-in-opposition is called for, the allegations made in the writ petition are deemed not to have been admitted.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
