11/06/2026 D/L - 43 Court No.28 S. Kundu Allowed C.R.M.(A) 1443 of 2026 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Manikchak P.S case no. 907 of 2025 dated 23/12/2025 under Sections 329(4)/118(2)/109/3(5) of the BNS.
In the matter of: Manik Mandal & Anr.
...Petitioners.
Mr. Apan Saha Mr. M.A. Sk.
Sk. S. Nawaj ...for the petitioners.
Mr. Krishnendu Bhattacharyya Mr. Sankalpa Bhattacharyya ...for the State.
1. Memo of evidence filed on behalf of the State is taken on record.
2. Learned counsel appearing on behalf of the petitioners submits as follows. There was a scuffle between family members which resulted in injuries. Both sides received injuries, but none was grievous in nature. There are case and counter case.
3. Learned APP representing the State relies on the case diary and opposes the prayer for anticipatory bail. He relies on the injury report which shows some injuries on vital parts of the body, like head. Although the allegations have been levelled against all the accused in equal measure by some of the witnesses, some of the independent witnesses point towards the culpability of
mainly the son of the present petitioners. The said coaccused was arrested and was thereafter granted bail.
4. Considering the above, the other materials available in the case diary, the fact that one of the principal accused was arrested and was thereafter granted bail and the fact that charge sheet has been submitted, I am inclined to grant anticipatory bail to the present petitioners.
5. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall surrender before the learned jurisdictional Court and pray for bail within four weeks from date. The petitioners shall regularly attend the jurisdictional Court and shall not threaten or intimidate the witnesses.
6. Accordingly, the application for anticipatory bail is allowed.
7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
