1. In this application the petitioner has prayed for a direction upon the Court below for expeditious disposal of Andal Police Station Case No. 276/2022 corresponding to G.R. Case No. 1583/2023 presently pending before learned Judicial Magistrate, 2nd Court, Durgapur.

2. Being aggrieved by the inordinate delay caused in disposal of the said criminal proceeding, learned Counsel for the petitioner submits that the case was registered on 1st August, 2022 and after completion of investigation Police submitted charge-sheet on 15th October, 2022.

Thereafter, the case has been fixed for appearance of the accused persons for last four years but since then charge hearing could not be made.

3. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if

it is allowed in terms of the prayer made in the application, the opposite parties will have no cause to prejudice and as such service of copy of application upon the opposite parties is dispensed with.

4. Having considered the submissions made by learned Counsel for the petitioner and considering the fact that after filing of charge-sheet in the year 2022, the charge hearing has not been made for last four years, I find that the prayer made by the petitioner is justified and required to be allowed in order to secure the ends of justice.

5. In view of the above, the instant application being CRR/2118/2026 is hereby disposed of with a direction upon the Court below to conduct charge hearing on the next date or within a month thereafter and to make every endeavour for expeditious disposal of the criminal proceeding within a shortest possible period.
