A direction to secure expeditious disposal of an application for temporary injunction under Order 39 Rules 1 and 2 read with Section 151 of the Code of Civil Procedure is the ultimate relief sought for in this case.
Mr. Debjit Mukerjee, learned advocate appearing for the petitioner/plaintiff submits that application for injunction was filed on 10th September, 2020, but the same could not be heard out, and disposed of by the Court bellow, taking the ground of Pandemic situation.
The only contention expressed by the learned advocate for the petitioner is against the delay caused in the disposal of suit.
No other point is raised requiring address by this Court.
In view of the nature of the order proposed to be made in this case, no prior notice is considered to be necessary upon the opposite party.
Service of notice of this application upon
opposite party stand dispensed with.
As it is gathered knowledge in course of hearing that the next date before the court below is on 15th July, 2022 for hearing of injunction application, so learned Judge, 7th Bench, City Civil Court, Calcutta in TS No. 603 of 2020 is requested to ensure expeditious disposal of pending injunction application referred hereinabove, either on the date scheduled, or if for any reasons whatsoever, the same could not be done, the injunction application may be disposed of peremptorily within three (03) weeks thereafter, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournments, unless it is extremely unavoidable.
Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite party and the opposite party. With this observation and direction, the revisional application stands disposed of.
Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
