Ld. advocate by referring to the medical documents also submits that the petitioner no.1 is suffering from serious ailments and the nature of the allegations which have been levelled against the petitioners are improbable, and the proceedings should not be allowed to continue under the garb of investigation.

I have considered the issues which have been canvassed by the ld. advocate for the petitioners and I am of the view that the same requires factual scrutiny and, as such, so far as the issue relating to continuance of the proceedings are concerned in respect of Women P.S. Case

No. 47 of 2024 dt. 3.2.2024 (Purba Bardhaman) and the same cannot be interfered at this stage.

However, the petitioner would be at liberty to approach this court at the appropriate stage of the proceedings after receiving the documents under section 207 of the cr.p.c.

With the aforesaid observations, CRR 1770 of 2024 is disposed of.
