Having considered the materials on record including the statements of witnesses and contemporaneous document i.e. seizure list showing recovery of 39 kgs. of ganja from the joint possession of the petitioner and the co-accused persons, we are of the opinion that in view of the statutory restrictions under Section 37 of the N. D. P. S. Act, we are of the opinion that this is not a fit case to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioners is rejected.
