... Petitioner.
Mr. Debapriya Samanta.
...for the Petitioner.
Mr. Sudip Ghosh, Mr. Bitasok Banerjee.
...for the State Heard the learned Advocates appearing for the parties. Petitioner renews his prayer for bail. He is in custody for about 269 days. It is further contended petitioner has been falsely implicated in the instant case and his signature does not appear in the seizure list.
Learned Advocate for the State opposes the prayer for bail.
We have considered the materials on record. Arrest memo prepared during investigation shows that the petitioner was arrested from the spot where recovery of narcotic substance above commercial quantity was made.
In view of the aforesaid incriminating materials on record and as prayer for bail of the petitioner was rejected in January, 2022 and there is no change in circumstances since then, we are not inclined to grant bail to the petitioner.
Accordingly, the prayer for bail of the petitioners is rejected.
