It has been further complained that as a result of such overt act, one of the licensee, namely, Smt. Arpita Ghosh Burnett was compelled to vacate and leave the flat. The petitioner is aggrieved by the excesses of the respondent no.5.

State has submitted a report

which reflects that no complaint was received from Smt. Arpita Bose (Ghosh) Burnett. However, a local enquiry was conducted by the police authorities and it has been found that the elder daughter of the petitioner, namely, Babita Kar, is the owner of Flat No. 2C and the Secretary of the Flat Owners' Association. The said Babita Kar and the respondent no.5 are at loggerhead.

There are other issues concerned.

Be that as it may, the nature of the dispute and difference is basically a family feud.

It is also pointed out that a civil suit being T.S.764 of 2025 has been filed which is pending before the learned Additional Civil Judge, 3rd Court, Junior Division, Alipore.

Having considered the fact that the civil court is already in seisin of the issues, the petitioner, if he is faced with

any inconveniences, he would report to the police authorities who would take steps in accordance with law.

With the aforesaid observations, WPA 10873 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
