The petitioner complains that the representation filed before the municipal authority on May 16, 2022 has not been considered till date.

It appears from the documents annexed to the writ petition that a demolition proceeding was initiated by the Kolkata Municipal Corporation.

The parties are not aware as to whether the said proceeding has been concluded or not.

The representation of the petitioner is pending consideration. In view of the above, the instant writ petition is disposed of by directing the respondent no. 3 or his delegate to consider the representation filed by the petitioner on May 16, 2022 strictly in accordance with law after giving opportunity of hearing to the petitioner as well as the private respondents and pass a reasoned order and communicate the same to the parties.

A decision shall be taken in the matter at the earliest but positively within a period of ten weeks from the date of communication of a copy of this order. It is made clear that this Court has not gone into the merits of the claim of the petitioner and all points are left open to be decided by the aforesaid respondent at the time of consideration of the representation filed by the petitioner.

Learned advocate for the petitioner is directed to forward a copy of the representation dated May 16, 2022 to the aforesaid respondent at the time of communicating the order of this Court.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
