In Re: CPAN 775 of 2024 1.
It is submitted on behalf of the petitioner that pursuant to the judgment and order dated 06.09.2023 as passed in WPA 7127 of 2019 the alleged contemnors have complied with the said order.

Such being the position, CPAN 775 of 2024 has now become infructuous and is thus disposed of.

The copy of the engagement letter in the name of the petitioner as filed today is taken on record. In Re: CPAN 1230 of 2024 1.
The supplementary affidavit as filed on behalf of the petitioners is taken on record.

It is submitted that by issuing two separate letters dated 30.08.2024 the Additional Director General, West Bengal Fire and Emergency Services communicates the petitioners that one of them has found unsuccessful in the enduring test and another one has crossed the qualifying age as on 01.01.2023.

Learned Advocate for the petitioners disputes the contents of such two letters. It is submitted by him that no result has been published showing that the petitioners are unsuccessful.

Per contra, Mr. Roy, learned Advocate for the alleged contemnor draws attention of this Court to paragraph no. 9 of the judgment and order dated 06.09.2023 as passed by this Court in WPA 7127 of 2019. It is submitted by Mr. Roy that pursuant to the said judgment and order dated 06.09.2023 the alleged contemnor has duly complied with the said judgment and order.

On perusal of the entire materials as placed before this Court and after hearing the learned Advocates for the contending parties it appears to this Court that the alleged contemnor has duly complied with the aforementioned judgment and order dated 06.09.2023 as passed in WPA 7127 of 2019. It reveals further that on
behalf of the alleged contemnor two letters dated 30.08.2024 were communicated to the petitioners to the effect that one of the petitioners found to be ineligible to be engaged as Auxiliary Fire Operator on contractual basis on account of his failure in enduring test and another on account of the crossing of the qualifying age as on 01.01.2023.

In view of such, there is nothing left in the instant contempt application and accordingly, the contempt application being CPAN 1230 of 2024 is disposed of. (Partha Sarathi Sen, J.)
