The petitioner was serving as the manager of Onda Large Size Co-operative Primary Agriculture Credit Society Limited. There is no elected board of the said co-operative society for a considerable period of time.
By order dated 21st March, 2024 in an earlier writ petition filed by the petitioner being WPA 2572 of 2024, the Court directed the Deputy Registrar Cooperative Societies to take immediate step for holding election.
The petitioner alleges that a Group-IV staff of the cooperative society has put a padlock in the almirah and is not allowing the petitioner to perform his daily duties.
Learned advocate representing the Deputy Registrar of Co-operative Societies draws the attention of the Court to the age of the petitioner. In the affidavit it has been mentioned that the petitioner is aged about 69 years. It has been submitted that he is running the show for nearly ten years and is not cooperating with the process of conducting election. It has been submitted that there is charge of defalcation of huge amount of money against the petitioner.
Be that as it may, as it appears that steps have been taken by the concerned Registrar of Co-operative Societies to hold election, accordingly, the petitioner is directed to cooperate in holding of the election. At this stage there is no requirement of handing over the key of the almirah to the petitioner. Only after a regular Board is elected, the almirah shall be opened. The concerned DRCS/ARCS is directed to take immediate steps in the matter.
The writ petition stands disposed of.
