Bihani Mr. Dwijodas Chakraborty ... for the Kolkata Municipal Corporation The petitioner prays for a direction upon the Kolkata Municipal Corporation to conclude the proceeding initiated against unauthorised construction at premises no.77, Bidhannagar Road, Ward No.13, Borough-III of the Kolkata Municipal Corporation. Kolkata Municipal Corporation conducted a hearing on 22nd March, 2021 but thereafter the proceeding has not been concluded as yet.

The present writ petition is disposed of by directing the Special Officer (Building) to conclude the proceeding being D Case No.01-D/III/2020-21 in accordance with law at the earliest but positively within a period of twelve weeks from the date of communication of this order, if not already concluded.

The final order passed shall be communicated to the parties.

Learned advocate for the petitioner is directed to forward a copy of the hearing notice dated 9th March, 2021 to the respondent authorities at the time of communicating the order of the Court.

The Executive Engineer (Civil)/Building of the Borough-III, is directed to ensure that no unauthorised construction is made in the subject premises till a final order is passed in the demolition proceeding initiated in response to the complaint filed by the petitioner. The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
