1. Learned advocate representing the petitioner submits in terms of previous order effort was made to effect service of notice upon the learned advocate representing the State respondents but notice could not be served due to non availability of the learned advocate.

2. Ms. Mousumi Banerjee, learned advocate is present in Court who usually represents State respondents.

3. Ms. Banerjee, learned advocate is requested to enter appearance on behalf of State respondents.

4. Office of the learned Government Pleader is requested to regularize engagement of Ms. Mousumi Banerjee, learned advocate on behalf of State respondents.

5. Husband of the petitioner was an assistant teacher who died-in-harness on 3rd August, 2016. After death of husband of the petitioner terminal benefits were released in favour of the petitioner upon issuing

Pension Payment Order dated 18th October, 2017. Petitioner claims interest on gratuity due to delayed payment.

6. Accordingly, the Director of Pension, Provident Fund and Group Insurance, West Bengal and the concerned Treasury Officer are directed to pay interest on gratuity at the rate of 8% per annum from the date following the date of death of husband of the petitioner till the date of release of the same, within a period of 8 (eight) weeks from the date of communication of this order.

7. Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

8. With the above observation, the writ petition stands disposed of.

9. There shall be no order as to costs.

10.Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
