Kanti Pal Mr. Debdut More ....for the petitioner This application under Article of the Constitution of India is at the instance of the defendant praying for a direction upon the learned Civil Judge (Jr. Div.), 1st Court at Barasat to dispose of the application under Order 39 Rule 1 and 2 of the Code of Civil Procedure filed by the opposite party herein and the application under Order 39 Rule 4 of the Code filed by the plaintiff/petitioner herein expeditiously. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocates representing the opposite party before the learned trial judge. From the order sheets appended to this application, this Court finds that July 24, 2025 has been fixed for
hearing of the injunction application and the application under Order 39 Rule 4 of the Code of Civil Procedure. It further appears from the order dated February 18, 2025 that parties were directed to exchange their affidavits in the meantime.
In the light of the submission made by the learned advocate for the petitioner, CO 1743 of 2025 is disposed of by requesting the learned Civil Judge (Jr. Div.), 1st Court at Barasat to take up the hearing of the applications one under Order 39 Rule 1 and 2 of the Code of Civil Procedure filed by the opposite party and the other under Order 39 Rule 4 of the Code of Civil Procedure filed by the petitioner herein on the next date fixed i.e. on July 24, 2025, if the same are otherwise ready for hearing and to make an endeavour to see that the same are disposed of as expeditiously as possible preferably within a period of two months from the next date fixed without granting any unnecessary adjournments to either of the parties.
There will be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
