Public Prosecutor Mrs. Sonali Das ... ... for the State It is submitted on behalf of the petitioner that he is in custody for about two years and six months. It is further submitted petitioner is not the principal accused and she has been falsely implicated in the instant case in order to deny her rights in the property of her deceased husband.
Learned Public Prosecutor as well as learned Additional Public Prosecutor oppose the prayer for bail and submit petitioner entered into a conspiracy with her daughter and the latter's friend to commit murder. Blood stained jewellery belonging to the deceased were recovered from her possession. Weapon of offence has been recovered on the leading statement of co-accused.
We have considered the materials on record. There are materials including recovery of jewellery of the deceased from the possession of the petitioner prima facie supporting the charge of conspiracy. Trial is in progress. In view of the aforesaid facts, we are of
the opinion this is not a fit case to grant bail to the petitioner at this stage.
The application for bail is thus rejected.
Trial court is directed to expedite the trial and conclude the same at an early date preferably within one year from the next date fixed for recording evidence without granting unnecessary adjournments to either of the parties.
