Case No. 256 of 2021 for examination of the accused under section 251 of the cr.p.c. and there are seven witnesses on whom the prosecution proposes to rely upon in order to prove its case.

Having considered the fact that the case was initiated in the year 2021, I direct that the ld. Magistrate would fix one date in every three months so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

On the next date so fixed, the ld. trial court would take efforts for completing the process of Section 251 of the cr.p.c., if not possible on the said date, then, within a month from the date so fixed the ld. trial court would take steps for

completing the process. Thereafter, the ld. trial court would proceed with the case by fixing a regular schedule in the mode and manner as directed above.

In case, any witness is not available, in that case, local police station may be informed so that summons are served upon the witnesses.

No unnecessary adjournments be granted to any of the parties. Ld. Public Prosecutor conducting the case would produce the materials, exhibits and documents on the date so fixed for examination of the witnesses. All stakeholders would cooperate with the ld. trial court so that the trial of the case is concluded at the earliest. The trial of the case would continue in spite of any resolution of the local Bar and the participating advocates in any manner or the other will not stall the proceedings in spite of such resolution. With the aforesaid observations, CRR 1775 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
