1. Leave is granted to the learned advocate representing the Board to affirm and file the report by the Deputy Secretary (General) of the West Bengal Board of Secondary Education in course of the day annexing copy of the communication dated 7th November, 2025.

2. The communication made by the Deputy Secretary (General) dated 7th November, 2025 has been forwarded to the school conveying the decision of the Board as regards regularization of the period of absence of the husband of the petitioner since deceased.

3. The Board has taken a decision that the period of absence of the deceased husband of the petitioner being an ex-Group-'D' staff of the school for the period from 12th April, 2022 to 12th November,

2023 on account of his detention in legal custody shall be treated as 'spent on duty'. In case the deceased had leave to his credit, the said period of absence shall be considered as 'leave with pay'.

4. The Board opined that the admissible benefit should be paid to the petitioner for distribution among all the legal heirs.

5. As it appears that the Board has already taken a decision and the same has been communicated to the District Inspector of Schools, Secondary Education, Purulia, accordingly, the instant writ petition is disposed of by directing the District Inspector of Schools, Secondary Education, Purulia to take steps for processing the documents relating to the terminal benefits of the deceased employee at the earliest but positively within a period of eight weeks from the date of communication of this order and forward it to the DPPG for issuance of the PPO.

6. The District Inspector of Schools, Secondary Education, Purulia shall ensure that all the terminal benefits of the deceased employee, as admissible, are disbursed positively by 31st March, 2026.

7. The writ petition stands disposed of.

8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
