1. The writ petitioner herein has challenged an order dated 22nd February, 2024, passed by the learned Central Government Industrial Tribunal, Kolkata, deciding a preliminary issue.

2. It is submitted by the parties that subsequently, the final award in the said reference case has been passed.

3. The petitioner now prays for leave to withdraw the present writ application in view of the judgment of the Hon'ble Supreme Court in Cooper Engineering Limited vs. Sri P.P. Mundhe delivered on 20th August, 1975 reported in 1975 (2) SCC 661 para 22 and submits that they now intend to challenge the final order/award.

4. Accordingly, the writ application is disposed of as 'withdrawn', with liberty granted to the petitioner to challenge the impugned final award.

5. Writ application stands disposed of.

6. Connected application, if any, stands disposed of.

7. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
