Mr. Arnab Chatterjee Ms. Dhanasree Biswas Ms. Poulami Bose ...for the Petitioner Mr. Saryati Dutta Mr. Aritra Bhattacharya ...for the State Learned counsel appearing on behalf of the petitioner submits that 55 bottles of triprolidine cough syrup was allegedly recovered from the exclusive possession of the petitioner and the petitioner is in custody for more than eight months and that the investigation has already been culminated into chargesheet but the charge has not yet been framed and nobody knows when the trial would be concluded and as such he may be released on bail on any terms and conditions.

Learned Counsel appearing on behalf of the State vehemently opposed the bail prayer contending that commercial quantity of narcotics was recovered from the exclusive possession of the

petitioner and the delay in trial is clearly attributable to the coaccused who are still absconding. Having heard learned counsel appearing on behalf of the petitioner as well as State and that commercial quantity of narcotics was recovered from the possession of the petitioner and that if the present petitioner is released on bail there is also serious chance of abscondence for which the trial may get further delayed and also having considered that the rigour of Section 37 of the NDPS Act clearly attracts in respect of the present petitioner in the instant case his prayer for bail is rejected. However, the learned Trial Court is requested to make every endeavour to expedite the trial.

Accordingly, C.R.M. (NDPS) 583 of 2025 stands disposed of. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities. (Dr. Ajoy Kumar Mukherjee, J.)
