This revisional application stood dismissed for default by an order dated 30th April, 2025. Later on the report dated 19th May, 2025 has been received by this Court, which reveals that this revisional application had already been allowed and disposed of vide order dated 2nd April, 2024 passed by the Hon'ble Justice Prasenjit Biswas. It is stated that the Rule Section was inadvertently sent the instant file along with other pending cases as old matters to this Hon'ble Court on 21st March, 2025 for necessary order and, accordingly prayed for unconditional apology in this regard.

On perusal of this report and coupled with the facts and circumstances it appears that because of negligence on the part of the department this matter appeared before this Court under the heading "Warning List" and in absence of either of the parties and considering the long pendency this Court passed the order dated 30.04.2025 dismissing the matter for default. However, in view of the report there is no point left to keep the matter pending any more.

Hence, the entire record be sent down to the department for taking necessary steps.

Department is directed to be more cautious while sending matters before this Court for hearing since most of the matters are very old and pending since long.
