The facts of the case have been recorded in the order dated 27.07.2021. The term of the technical member of the West Bengal Taxation Tribunal, Mr. C. M. Bachawat is expiring today. The functioning of the Tribunal would indeed come to a standstill.
As a very special case, the term of Mr. C. M. Bachawat, technical member of West Bengal Taxation Tribunal shall stand
extended for a period of three months from date and he shall continue to function as such from tomorrow.
The aforesaid extension shall not prevent the constitution of any Selection Committee or any decision being taken by the Selection Committee to appoint any person as such technical member.
It is made clear that in the event a new technical member is appointed within the next three months, the term of Mr. C. M. Bachawat would automatically expire thereupon. The State Government will take appropriate steps to extend the term of Mr. Bachawat in terms of this order. With the aforesaid observations, the writ petition is disposed of.
There shall be no order as to costs.
