Pursuant to the order dated 9th June 2023, the appellants have separately affirmed the affidavit and given an undertaking to this Court that they would vacate the suit premises within six months from 9th June 2023 and shall continue to pay the occupational charges as contractual rate for such period.

They have also given an undertaking not to sublet, assign and/or transfer the suit premises to any person. Let such undertaking be accepted.

In view of the filing of the undertaking and the fact that the appeal was dismissed on 9th June 2023, the instant appeal shall not be shown pending in the docket of this Court.

Since an undertaking has been accepted, there shall be stay of all further proceedings in Title Execution Case No. 9 of 2013 pending before the learned Civil Judge (Junior Division), First Court, Sealdah for the aforesaid period of six months.
