It is a case under Sections 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. Learned advocate appearing for the petitioner submits that the petitioner after receiving bail in a different case was falsely entangled in this case.

Learned advocate appearing for the State opposes the prayer for bail and submits that commercial quantity of 'ganja' was seized from the possession of the petitioner amounting to 24.02 kgs.

Heard the submissions made by the learned advocates of both sides. Perused the case diary. The petitioner has not been able to rebut the presumption drawn against him under Section 37 of the NDPS Act. Despite the period of his detention, we are unable to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.

CRM 4844 of 2021 is accordingly disposed of.
