In view of the innocuous nature of the order proposed to be passed, no prior service of notice on the opposite parties is deemed necessary.

C.O. 1309 of 2021 is disposed of by requesting the Civil Judge (Junior Division), Second Court at Malda to dispose of all applications pending in the said court in connection with Title Suit No. 117 of 2017 as expeditiously as possible, preferably within one month from the date of communication of this order to the court below.

The trial court shall, thereafter, endeavour to dispose of the suit itself at the earliest, preferably within one year from the date of disposal of the applications. The petitioners shall communicate this order to the opposite parties and/or their advocate in the court below as well as to the trial court, along with a server copy of this order.

The court below shall act on such server copy without insisting upon prior production of a certified copy.

There will be no order as to costs.

Urgent website certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
