Affidavit-of-service filed in Court today is taken on record.

The petitioner is a primary school teacher. He was suspended as he was in jail custody for a period exceeding 48 hours on criminal charges in connection with Karimpur P.S. Case No.58 of 2022 dated 28th March, 2022. He was enlarged on bail on 26th June, 2022 vide order passed in CRM (DB) 1955 of 2022. He has made a prayer for resuming service which is pending consideration at the end of the Chairman, District Primary School Council, Nadia.

It has been submitted by the learned advocate appearing on behalf of the petitioner that no disciplinary proceeding has been initiated by the authority against the petitioner till date.

Without going into the merits of the said representation, the instant writ petition is disposed of by directing the Chairman, District Primary School Council, Nadia to consider the prayer made by the

petitioner in accordance with law, at the earliest, but positively within a period of 60 days from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.

Learned advocate for the petitioner is directed to forward a copy of the representation dated 18th December, 2023 along with all documents in support of his prayer to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
